We’ve recovered tens of millions for clients in New Jersey, from Trenton to Newark, and nationwide including New York, Florida, Texas, and California.

Resolving Life Insurance Disputes in New Jersey

New Jersey life insurance claims are governed largely by Title 17B of the New Jersey Statutes, which sets rules for premium payments, claim handling, contestability, and payment of death benefits.

30-Day Grace Period: Under N.J.S.A. § 17B:25-3, individual life insurance policies generally provide a 30-day grace period for missed premiums. If the insured dies during that period, coverage remains in force, although the overdue premium can be deducted from the benefit.

Claim Payment Deadline: Under N.J.S.A. § 17B:25-11, life insurance benefits generally must be paid within 60 days after the insurer receives due proof of death. Overdue proceeds can accrue interest under New Jersey law.

Claim Investigation Deadlines: If a claim requires further investigation or is denied, New Jersey imposes additional written-notice and decision deadlines on the insurer.

Contestability Period: Under N.J.S.A. § 17B:25-4, a policy generally becomes incontestable after it has been in force during the insured’s lifetime for two years, except for nonpayment of premiums.

Application Misstatements: New Jersey insurers generally must show that an incorrect application answer was material enough to affect the decision to issue the policy or assess the risk.

Insurance laws and claim requirements vary by state. A life insurance claim in New Jersey may be handled differently from one in Maryland, Connecticut or Massachusetts.

Our New Jersey life insurance attorneys can review whether the insurer has sufficient evidence to challenge your benefits.

Not All Denials Are Legitimate. Here’s What to Know

Life insurance companies in Red Bank,Toms River, and across New Jersey deny claims for many reasons. Some involve legitimate coverage issues, while others can result from overly aggressive policy interpretations or problems with how the claim was handled.

Common Reasons Claims Are Denied

  • Inaccurate or incomplete application information
  • Lapsed coverage due to missed premiums
  • Suicide or self-inflicted injury exclusions
  • Beneficiary disputes
  • Contestability period reviews

When a Denial May Involve Bad Faith

  • Unexplained or unreasonable delays
  • Misstating or misapplying policy terms
  • Ignoring medical evidence
  • Rescinding coverage after a claim is filed

Whether your claim involves a standard dispute or potential bad faith, our life insurance attorneys can evaluate your case and pursue the full benefit owed.

You can file an insurance complaint or request consumer assistance through the New Jersey Department of Banking and Insurance.

Questions You Might Be Asking Right Now

Can a spouse contest a life insurance beneficiary?

Yes. New Jersey law can affect beneficiary rights after divorce, and a former spouse’s designation may be revoked in some cases. Divorce agreements, court orders, and policy terms can affect who receives the payout.

Can a life insurance claim be paid if the policy lapsed?

Sometimes. New Jersey individual life policies generally provide a 30-day grace period, so a missed payment does not necessarily mean coverage ended immediately.

Can a last-minute insurance beneficiary change be contested?

Yes. If a beneficiary change was made due to pressure, fraud, or diminished mental capacity, it may be challenged and potentially overturned.

Can a beneficiary be changed after the policyholder’s death?

No. Beneficiary designations must be finalized while the policyholder is alive. Any changes made after death should be viewed with suspicion and reviewed immediately.

How can I find a missing life insurance policy in New Jersey?

The New Jersey Department of Banking and Insurance directs consumers to the NAIC Life Insurance Policy Locator, a free service that can help locate a deceased person’s missing life insurance policy or annuity.
