Missed Premiums: Under Texas Insurance Code § 1101.005, individual life policies generally must provide at least one month to make an overdue premium payment while the policy remains in force.
Two-Year Incontestability Rule: Under § 1101.006, a life insurance policy generally becomes incontestable after it has been in force during the insured’s lifetime for two years, with limited exceptions such as nonpayment of premiums.
Intent to Deceive: Texas does not let an insurer void a life policy simply because an application answer was wrong. The insurer generally must show the statement was material and made with intent to deceive.
Prompt Payment Rules: Chapter 542 of the Texas Insurance Code sets deadlines for insurers once they have the information reasonably needed to process a claim.
18% Interest + Attorney Fees: A qualifying prompt-payment violation can require the insurer to pay 18% annual interest on the claim amount plus reasonable and necessary attorney fees.
