Arkansas Rules That Can Increase What an Insurer Owes
Arkansas has unusually specific rules governing delayed life insurance payments and the additional amounts an insurer may owe.
30-Day Claim Processing Limit: Arkansas allows insurers time to investigate and process an individual life insurance claim, but that period cannot exceed 30 days after proof of death is furnished.
8% Interest: If qualifying proceeds remain unpaid beyond that period, the insurer can owe 8% annual interest, with interest on covered unpaid proceeds running from the insured’s date of death.
12% Damages + Attorney Fees: Under Ark. Code § 23-79-208, a life insurer that fails to pay a covered loss within the required time after demand can face 12% additional damages plus reasonable attorney fees when the statute’s requirements are met.
Refund of Unearned Premiums: Arkansas can also require premiums paid for periods extending beyond the policy month in which the insured died to be returned as part of the death claim.
Rules can differ across state lines, so a claim in Arkansas may be treated differently than one in Louisiana, Missouri, or Tennessee.
