Contestability Period for Life Insurance Claims in Hawaii
Under Hawaii Revised Statutes § 431:10D-102, life insurance policies generally become incontestable after two years during the insured person’s lifetime, except for nonpayment of premiums.
Hawaii law also requires a 30-day grace period for late premiums. During that time, the policy remains in force.
Even after the contestability period ends, insurers may still rely on certain policy exclusions or coverage restrictions.
Reinstated policies may also face a new contestability period if fraud or material misrepresentations were involved.
If your claim was denied under these rules, our attorneys can review the insurer’s reasoning and determine whether the denial complies with Hawaii law.
Legitimate vs. Illegitimate Life Insurance Claim Denials
While some claim denials may be valid, insurers often rely on weak interpretations, incomplete records, or questionable reasoning to avoid paying your benefits.
Knowing the difference can help you decide whether your denial should be challenged.
Reasons a Claim May Be Legitimately Denied:
- The policy clearly excluded the reported cause of death
- Required premiums were not paid and the policy had legally lapsed
- Material information on the application was proven to be false
- The person filing the claim is not the lawful beneficiary
- The claim falls within a valid policy limitation or exclusion
Signs the Denial May Be Illegitimate:
- The insurer cannot clearly explain why your claim was rejected
- Your payment history, medical records, or other evidence was overlooked
- Policy language is being stretched beyond its intended meaning
- The company raises new objections only after you file the claim
- Your claim is delayed for months without a clear reason
Boonswang Law represents beneficiaries throughout Hawaii and across the mainland, including clients in Washington and Oregon. If your claim has been denied, we’ll review the insurer’s decision and fight for the benefits you’re entitled to.

Steps You Can Take to Protect Your Claim
The steps you take after a denial or delay can affect your ability to recover the life insurance benefits you’re owed.
Follow these guidelines to protect your claim:
Get the Denial in Writing
Ask the insurer to explain why your claim was denied and identify the policy terms or records it relied on.
Keep Every Important Document
Save the policy, application, premium history, claim forms, beneficiary records, letters, emails, and any other paperwork tied to your claim.
Avoid Signing Away Your Rights
Before accepting a reduced payout or signing a release, make sure you know whether you may still be entitled to the full benefit.
Have a Life Insurance Lawyer Review Your Case
Our attorneys can examine the insurer’s reasoning, identify problems with the denial, and determine the best way to challenge it.
If your benefits are being withheld, acting quickly can give you a stronger chance of recovering the payout your loved one intended for you. Get in touch with us as soon as possible.

Common Questions About Life Insurance Law
Can a spouse contest a life insurance beneficiary?
Yes. A current or former spouse may be able to challenge the beneficiary designation if there are issues involving divorce, marital rights, or questions about whether the designation was legally valid.
Can a life insurance claim be paid if the policy lapsed?
Yes, in some cases. A grace period, payment history, notice requirements, or other policy terms may show that coverage was still in effect when the insured passed away.
Can a last-minute insurance beneficiary change be contested?
Yes. A recent beneficiary change may be challenged if there is evidence of fraud, coercion, undue influence, or concerns about the policyholder’s ability to make that decision.
Can a beneficiary be changed after the policyholder’s death?
Generally, no. The beneficiary designation in effect when the insured dies usually controls who receives the benefits, though disputes over the validity of that designation can still arise.
