Arizona Rules That Can Affect Whether a Life Insurance Claim Gets Paid

Arizona has specific rules for application disputes, delayed payments, and group life insurance claims that can directly affect a beneficiary’s right to payment.

Three-Part Misrepresentation Test: Under A.R.S. § 20-1109, an incorrect application statement does not automatically defeat a claim. To prevent recovery, the insurer generally must satisfy all three statutory requirements involving fraud, materiality, and whether the true facts would have changed how the policy was issued.

30-Day Payment Rule: If an insurer has received an acceptable proof of loss containing the information needed to decide a qualifying claim, payment delayed beyond 30 days can trigger interest from the date the claim was received. Exceptions can apply, including when a claim is denied in good faith within that period.

Application Evidence Protection: A life insurance application generally cannot be used as evidence against the beneficiary unless a true copy was attached to or otherwise made part of the policy when it was issued.

Death During Group-Life Conversion: If an insured dies during a qualifying group-life conversion period, the amount eligible for conversion can still be payable under the group policy even if no conversion application or first premium was submitted.

Life insurance rules are set at the state level, which means a claim in Arizona may face different requirements than one in Nevada or New Mexico.

Our life insurance attorneys can review the policy and claim history to determine whether you have grounds to challenge the decision.

Signs Your Claim Denial May Be Illegitimate

A denied claim isn’t always the final word, especially when the insurer’s explanation does not match the policy or the facts of your case.

Common Reasons Your Life Insurance Claim May Be Denied:

  • Alleged inaccurate information on the original application
  • A claimed lapse caused by unpaid premiums
  • An exclusion related to the insured’s cause of death
  • Questions about who should receive the policy proceeds
  • A review during the policy’s contestability period
  • Problems tied to employer-provided group coverage

Signs The Denial May Be Worth Challenging:

  • The insurer gives you a vague or shifting reason for the denial
  • Important medical records, payment records, or other evidence were not fully considered
  • The policy language appears to be applied unfairly against your claim
  • Your payout has been held up without a clear explanation
  • The insurer is relying on facts that do not appear to support its decision

If the denial is based on an application answer, Arizona places specific limits on when that information can prevent recovery. The insurer generally must satisfy the state’s requirements for fraud, materiality, and how the correct information would have affected issuance of the policy.

Our life insurance lawyers can review the denial and determine whether you have a path to recover the benefits your loved one intended for you.

You can also file a complaint about a denied, delayed, or mishandled claim through the Arizona Department of Insurance and Financial Institutions.

Which Type of Benefits Dispute Are You Facing?

A denied claim, delayed payout, or disagreement over coverage doesn’t mean you’ve lost your right to benefits.

What To Do If Your Life Insurance Claim is Denied

The steps you take after a life insurance claim denial can protect your right to challenge the insurance company. Here’s what to do:

Request a Written Explanation

Ask the insurer to explain the exact reason for the denial and the policy language or records it relied on.

1

Collect Your Claim Documents

Keep the policy, application, premium history, beneficiary forms, medical records, claim paperwork, and every letter or email from the insurer.

2

Hold Off on Signing Anything

Do not accept a reduced payment or sign a release until you know whether you may be entitled to a larger payout.

3

Get a Legal Review

Our life insurance lawyers can examine the denial, compare it against the policy and supporting evidence, and determine how to challenge the insurer’s decision.

4

Acting quickly gives your attorney more time to gather evidence and pursue the benefits you’re owed.

You shouldn’t have to spend your time chasing records, answering insurer questions, or arguing over policy language while you’re grieving.

For Arizona claims, Boonswang Law can coordinate with Arizona-admitted local counsel and may seek pro hac vice admission when a specific court case requires it and the court approves.

Our attorneys take over your claim and build the evidence needed to pursue the benefits you’re entitled to. Here’s how we do it:

  • Reviewing the policy, coverage terms, and benefit amount
  • Examining the denial letter for weak or unsupported reasoning
  • Comparing the insurer’s decision against the application and claim records
  • Reviewing premium history, medical records, beneficiary forms, and other key documents
  • Gathering additional evidence that supports your right to payment
  • Communicating directly with the insurance company on your behalf
  • Preparing an appeal or taking legal action when needed

Clear Answers To Guide Your Next Steps

Can a spouse contest a life insurance beneficiary?

Potentially. Arizona law generally revokes certain revocable beneficiary designations in favor of a former spouse after divorce or annulment, unless an exception applies. The rule can also affect certain relatives of the former spouse.

Can a life insurance claim be paid if the policy lapsed?

Possibly. Arizona generally requires a 30-day or one-month grace period for premiums after the first, during which coverage remains in force. The premium history and actual lapse date should be checked before assuming the policy had already ended.

Can a last-minute insurance beneficiary change be contested?

Yes, you may be able to challenge a recent beneficiary change if there is evidence of undue influence, duress, lack of capacity, or problems with how the change was completed.

Can a beneficiary be changed after the policyholder’s death?

Generally, the policyholder’s right to change a beneficiary ends at death, so the designation that was valid at that time usually determines who receives the proceeds unless a successful legal challenge changes the outcome.

How can I find a missing life insurance policy in Arizona?

The Arizona Department of Insurance and Financial Institutions provides information about the free NAIC Life Insurance Policy Locator and other resources for finding missing life insurance coverage.
